1. Terms of Service

1.1 Acceptance of Terms

By accessing or using any products, services, or the website of Braivex, you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, please discontinue use immediately. These Terms apply to all users, clients, visitors, and others who access or use our platform.

1.2 Services Description

Braivex provides an Enterprise AI Agent Platform enabling businesses to deploy context-aware AI agents that automate customer conversations, support workflows, and business operations across chat, voice, email, and integrated systems. Services include but are not limited to:

  • AI agent development, deployment, and management.
  • Custom automation and workflow integration.
  • Consulting, onboarding, and technical support services.
  • Access to the Braivex SaaS platform and associated APIs.

1.3 Account Registration

To access certain services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your login credentials secure and confidential.
  • Notify us immediately of any unauthorized access to your account.

Braivex is not liable for any loss or damage resulting from your failure to comply with these obligations.

1.4 Acceptable Use

You agree not to use Braivex's services to:

  • Violate any applicable local, national, or international law or regulation.
  • Transmit or store any unlawful, harmful, defamatory, or fraudulent content.
  • Reverse engineer, decompile, or attempt to extract the source code of our platform.
  • Introduce malicious code, malware, or disruptive technologies into our systems.
  • Use the platform to build competing services without prior written consent.
  • Impersonate any person or entity or misrepresent your affiliation.

1.5 Intellectual Property

All content, code, trademarks, logos, software, and materials on the Braivex platform are the exclusive property of Braivex or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the platform solely for your internal business purposes in accordance with these Terms. No rights are transferred beyond this limited license.

1.6 Payment Terms

All fees for Braivex services are stated at the time of purchase and are payable in Indian Rupees (INR) unless otherwise agreed. Payments are due in advance for subscription services. Braivex reserves the right to suspend or terminate access for non-payment. All fees are exclusive of applicable taxes, which are the client's responsibility.

1.7 Limitation of Liability

To the maximum extent permitted by applicable law, Braivex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising from your use of or inability to use our services. Braivex's total cumulative liability shall not exceed the amounts paid by you to Braivex in the three (3) months preceding the claim.

1.8 Disclaimer of Warranties

Braivex's services are provided 'as is' and 'as available' without warranty of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or entirely secure.

1.9 Termination

Either party may terminate these Terms upon written notice. Braivex may immediately suspend or terminate your access if you breach any provision of these Terms. Upon termination, your right to access the platform ceases. Provisions relating to intellectual property, limitation of liability, and governing law shall survive termination.

1.10 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts in Rajasthan, India.

1.11 Modifications to Terms

Braivex reserves the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or platform notification. Continued use of our services after such notice constitutes acceptance of the updated Terms.
